PUREFORGE ATOMIC-FORGED® BRAKE ROTORS, LIMITED WARRANTY

What the Warranty Covers: Tech M3, Inc., a Delaware corporation (dba PureForge®) (“PureForge”), warrants, as specifically provided in the Limitations section below, all PureForge Brake Rotors to be free from defects in materials and workmanship during the period beginning on the date of purchase and ending on the earlier of three years after such date or 100,000 miles of service for material or workmanship defects in the PVD rotor surface treatment; and concurrently and separately, for the earlier of one year after such date or 100,000 miles of service for the underlying rotor assembly (the “Warranty Period”). In addition, PureForge guarantees the performance and longevity of the PureForge Brake Rotors, as measured against PureForge’s published specifications for the applicable part, under normal and recommended operating conditions during the Warranty Period, subject to the terms set forth in this Limited Warranty. If a PureForge Brake Rotor is found to be defective during the applicable Warranty Period, PureForge will, at its election, repair the rotor or replace it with a new or equivalent PureForge Brake Rotor. Replacement rotors are warranted for the remainder of the original Warranty Period. Unless separately agreed in writing, PureForge does not pay for removal, installation, labor, towing, vehicle downtime, diagnostic charges, loss of use, or loaner vehicles.

Limitations: This warranty is extended to the original purchaser and, where the PureForge rotors are sold to or through an authorized reseller, distributor, upfitter, or fleet-services provider, to the fleet owner or operator on whose vehicles the rotors are installed. This limited warranty is not otherwise transferable unless otherwise specified by a written agreement which an authorized PureForge officer ratifies and executes. The PureForge warranty does not cover any loss due to misuse, alteration, accident, abuse, neglect, metal on metal wear from brake pads or backing plates, damage resulting from brake system failures (be it partial or total) not caused by the PureForge Brake Rotors (such as metal-to-metal contact from worn brake pads or backing plates; seized, dragging, leaking, improperly adjusted, damaged, or misaligned calipers or related hardware; hydraulic, ABS, electronic parking-brake, wheel-bearing, hub, suspension, wheel, tire, or other vehicle-system failures not caused by the PureForge rotor), failure to follow PureForge break-in guidelines, failure to maintain the PureForge Brake Rotors in accordance with PureForge guidelines, or improper application or installation of the products. This warranty applies only to PureForge Brake Rotors that are used in conjunction with PureForge-recommended brake pads and does not cover damages causally related to use of non-recommended pads. This warranty does not cover damage, wear, or performance conditions caused by brake pads other than PureForge-recommended pads, and the use of such other pads voids this warranty. This warranty applies to PureForge Brake Rotors installed on passenger cars, vans, light trucks, or municipal and public-safety vehicles, including, without limitation, law enforcement and first responder vehicles. This warranty does not apply to products installed on vehicles or equipment used for the following: racing, high-performance driver education (HPDE) events, track days, lapping or open-lapping sessions, autocross, drag racing, time trials, rallying, or any other timed, competitive, or closed-course driving event (whether or not sanctioned and whether or not conducted for a prize), off-highway recreation, off-highway competition, or if used in any aircraft, aviation, or marine application. This warranty also does not cover PureForge Brake Rotors used in the operation of a vehicle that exceeds any applicable gross vehicle weight rating (GVWR), gross axle weight rating (GAWR), gross combined weight rating (GCWR), payload rating, tongue-weight limit, hitch rating, tire or wheel load rating, or other manufacturer or legal weight limit (including, but not limited to: overloaded or overweight vehicle operation, overweight trailering, or towing beyond the lowest applicable vehicle, hitch, trailer, axle, tire, wheel, or legal limit.) PureForge Brake Rotors must be installed and serviced by a qualified, ASE-certified technician or another qualified technician approved by PureForge (such approval will be subject to a good-faith determination by PureForge and will not be unreasonably withheld). This warranty does not cover rotors that are resurfaced or machined following purchase. This warranty does not cover damage or conditions caused by installation or service that does not meet these requirements. The warranty does not cover any loss or liability for incidental or consequential damages that may be caused by a breach of this written warranty (including, without limitation, personal injury or death or fraud), except that nothing in this Limited Warranty excludes or limits liability for personal injury or death, for fraud, or for any other liability that may not lawfully be excluded under the laws of the applicable jurisdiction.

For this warranty to apply, the vehicle upon which the PureForge Rotors are installed must be periodically inspected at 10,000-mile intervals, and preventive maintenance must be performed as-needed following inspection. Each 10,000-mile preventivemaintenance inspection must include, as applicable: (a) rotor inspection for wear, cracking, heat checking, scoring, glazing, pitting, corrosion, contamination, runout, disc thickness variation, and minimum thickness, with thickness and runout measurements recorded using properly calibrated equipment; (b) brake-pad and friction-material inspection; (c) inspection of calipers, pistons, slide pins, guide bushings, seals, boots, mounting hardware, brackets, abutment surfaces, and pad-retention hardware, with cleaning, lubrication, adjustment, repair, or replacement as required; (d) inspection of brake hoses, hard lines, fittings, master-cylinder and reservoir condition, brake-fluid level and condition, leaks, and restrictions; (e) inspection and verification of wheel bearings, end play, hub-face cleanliness and runout, wheels, tires, fasteners, and wheel-nut torque; (f) functional inspection of the parking brake and, when indicated, ABS, electronic/mechanical parking brake, brake-wear sensors, and related controls; and (g) a road test or other professional functional verification, when safe and appropriate. This warranty does not cover PureForge Rotors where there is a failure to satisfy the inspection and preventive-maintenance requirements, failure to retain the required records, or continued use after a warning light, abnormal noise, vibration, pulsation, pull, drag, overheating, fluid leak, or other condition reasonably requiring inspection. Failure to complete or document required preventive maintenance is grounds for PureForge to deny a warranty claim, to the extent the failure to undergo preventive maintenance caused or contributed to the claimed condition or where a lack of substantiating documentation of preventive maintenance renders PureForge unable to reliably evaluate a warranty claim in good faith.

The following defects and longevity/performance issues are covered by this warranty:

• Structural cracking or separation as follows:
  • The earlier of three years from date of purchase or 100,000 miles for structural cracking or separation to the PVD treatment of the rotor; and/or
  • The earlier of one year from date of purchase or 100,000 miles for structural cracking or separation to the underlying assembly of the rotor.
• Excessive or abnormal brake rub track wear (e.g., glazing, pitting, or grooves) as follows:
  • The earlier of three years from date of purchase or 100,000 miles for excessive or abnormal brake rub track wear to the PVD treatment of the rotor; and/or
  • The earlier of one year from date of purchase or 100,000 miles for excessive or abnormal brake rub track wear to the underlying assembly of the rotor.
• Rotor wear below minimum safe thickness as follows:
  • The earlier of three years from date of purchase or 100,000 miles for rotor wear below minimum safe thickness (as measured against manufacturer’s published specifications for the applicable part) resulting from defects in materials or workmanship to the PVD treatment of the rotors; and/or
  • The earlier of one year from date of purchase or 100,000 miles for rotor wear below minimum safe thickness (as measured against manufacturer’s published specifications for the applicable part) resulting from defects in materials or workmanship to the underlying assembly of the rotors.
• Development of Disc Thickness Variation (DTV) as follows:
  • The earlier of three years from date of purchase or 100,000 miles for DTV resulting from defects in materials or workmanship to the PVD treatment of the rotors; and/or
  • The earlier of one year from date of purchase or 100,000 miles for DTV resulting from defects in materials or workmanship to the underlying assembly of the rotors.

This warranty does not cover defects or longevity/performance issues resulting solely in personal discomfort, noise, rust, vibrations, or harsh riding characteristics

EXCEPT AS EXPRESSLY STATED IN THIS LIMITED WARRANTY, PUREFORGE MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED. SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES TO CONSUMERS, SO THE ABOVE LIMITATIONS ON IMPLIED WARRANTIES MAY NOT APPLY TO YOU. HOWEVER, ANY IMPLIED WARRANTIES TO CONSUMERS UNDER THE LAWS OF AN APPLICABLE JURISDICTION, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE, SHALL BE LIMITED IN DURATION TO THE APPLICABLE WARRANTY PERIODS STATED ABOVE. WHERE THE PUREFORGE BRAKE ROTORS ARE PURCHASED SOLELY FOR COMMERCIAL, MUNICIPAL, OR FLEET USE AND NOT AS A CONSUMER PRODUCT, PUREFORGE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Nothing in this Limited Warranty relieves any driver or operator from the duty to operate safely, maintain a safe following distance, obey posted limits and warnings, account for weather and road conditions, remain within all vehicle and towing ratings, and comply with applicable laws.

The foregoing provisions of this Limitations section states PureForge's entire and exclusive liability, and the buyer's exclusive and sole remedy, for any damages or claim made in connection with the sale of PureForge Brake Rotors. No other warranty, express or implied, shall exist.

Warranty claim guidelines: Warranty claims must be submitted within thirty (30) days after discovery of any damage, defect or failure through the PureForge warranty portal located at www.PureForge.com, or via email to brakewarranty@pureforge.com, or by calling (248) 481-7096. As part of the warranty process, you will be required to return the Brake Rotor that is the subject of the claim along with the brake pads used with such Brake Rotor to PureForge at the address below. You will be required to pay for shipping these parts to PureForge. Products must be returned in their original, unmodified condition to PureForge for warranty consideration and must be appropriately packaged to avoid damage while in transit. You assume the risk of loss until the product is delivered to PureForge, and PureForge will not cover damage incurred while in transit. In addition, you may be required to provide the following information:

• Valid proof of purchase and receipt for the at-issue Rotor from PureForge or an authorized reseller
• Date and mileage at the time the defect or non-performing condition was first detected
• Photos of the defective or non-performing parts in sufficient resolution for PureForge to assess the warranty claim
• A detailed description of the purported defective condition of the Rotor
• Vehicle year, make, model, trim, VIN, mileage at installation, date of installation, and current mileage
• Maintenance, repair orders, and installation records applicable to the defective or non-performing parts and vehicle the parts were used on
• Any notes from the drivers or operators of the vehicle which relate to the claimed defect or non-performing condition and its diagnosis
• Other information reasonably necessary for PureForge to determine cause, coverage, and compliance with these Warranty terms and conditions, with the end-user expected to comply with all reasonable requests for such information

What PureForge will do: If a valid warranty claim is identified following a good-faith inspection by PureForge, PureForge, at its election, will repair or replace the at-issue product with an identical or functionally identical new PureForge Brake Rotor.

PureForge reserves the right, at its sole discretion, to provide a monetary refund instead of a replacement. PureForge also will determine, reasonably and in good faith, whether any returned PureForge Brake Rotor satisfies the conditions of the warranty. If a claim is denied, PureForge will provide the claimant with a written explanation of the basis for the denial and the supporting inspection findings, and will consider any additional information the claimant submits within thirty (30) days of the denial.

NO PERSON IS AUTHORIZED TO MODIFY THIS LIMITED WARRANTY IN ANY WAY, EXCEPT BY A WRITING SIGNED BY AN AUTHORIZED OFFICER OF PUREFORGE

The foregoing states the final, complete, and exclusive statement on warranty terms related to PureForge Brake Rotors. This warranty gives you specific legal rights and you may also have other rights which vary from state to state. This Limited Warranty is governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. PureForge does not offer an informal dispute settlement mechanism under 16 C.F.R.
